Terms of Service

1. Introduction and Acceptance

Welcome to Tailo. These Terms of Service ("Terms") govern your access to and use of the Tailo website, mobile applications, and services (collectively, the "Service"), operated by Tailo ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Tailo provides an AI-powered dog behaviour analysis platform that:

  • Analyses video recordings of dogs to identify potential stress indicators and behavioural patterns
  • Provides educational insights about dog behaviour and communication
  • Offers guidance on training and understanding your dog

Important: Tailo is an educational tool and does not provide veterinary, medical, or professional dog training advice. Our analysis is intended for informational purposes only and should not replace consultation with qualified professionals.

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

4. User Content and Uploads

Our Service allows you to upload videos and images of your dogs ("User Content"). By uploading User Content, you:

  • Retain ownership of your User Content
  • Grant us a licence to process, analyse, store, and use your User Content for the purpose of providing the Service and for AI training purposes
  • Represent that you have the right to upload such content
  • Understand that uploaded content is processed by AI systems to provide analysis
  • Consent to your User Content being used for AI model training and research to improve dog behaviour analysis capabilities

We store User Content securely using AWS S3 cloud storage. Videos are processed by Google's Gemini AI for behavioural analysis.

AI Training and Research

Any video or image uploaded to Tailo may be used for AI training purposes to advance research in canine behaviour analysis and improve the accuracy of our AI models. Your uploaded content contributes to the development of better tools for understanding dog behaviour and welfare.

Data Retention and Your Rights

All uploaded content is stored on our servers unless you request its removal. Under the General Data Protection Regulation (GDPR), you have the right to request deletion of your personal data, including any uploaded videos and images. To submit a data removal request, please contact us at maria@tailo.dog with the subject line "GDPR Data Removal Request". We will process your request within 30 days in accordance with applicable data protection laws.

5. Acceptable Use

You agree not to use the Service to:

  • Upload content that depicts animal cruelty, abuse, or harm
  • Upload content featuring humans without their consent
  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Upload malicious content or attempt to compromise our systems

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Tailo and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent. You may not copy, modify, distribute, or create derivative works based on our Service without express permission.

7. Third-Party Services

Our Service integrates with third-party services, including:

  • Google Gemini AI: For video analysis and behavioural interpretation
  • AWS S3: For secure storage of uploaded content
  • PostHog: For analytics and service improvement

Your use of these integrated services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI ANALYSIS RESULTS

We do not warrant that the Service will be uninterrupted, secure, or error-free. AI-generated analysis may contain inaccuracies and should not be relied upon as definitive behavioural assessment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Any damages arising from reliance on AI analysis results
  • Any actions taken based on the Service's recommendations

Our total liability shall not exceed the amount you paid us, if any, for access to the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Tailo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload to the Service

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and User Content
  • Provisions that by their nature should survive termination will remain in effect

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland, United Kingdom, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Scotland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending email notification for significant changes (if you have an account)

Your continued use of the Service after changes constitutes acceptance of the modified Terms.
